Limited Parts Warranty for Mattson ML Loaders,

This Limited Parts Warranty is effective as of the date of purchase and is entered into by and between FTM Group LTD, hereinafter referred to as the "Supplier," and the purchaser, hereinafter referred to as the "Customer."

1. Warranty Coverage

The supplier warrants that the parts of the earthworks machine purchased from FTM Group LTD shall be free from defects in material and workmanship under normal use and service for a period of 12 months or 2000 hours whichever comes first, starting from the date of delivery to the Customer.

2. Warranty Claims Procedure

During the Warranty Period, if any part of the earthworks machine is found to be defective, the Customer must notify the supplier in writing within a reasonable time after the discovery of the defect. The Customer shall provide all necessary information and documentation to support the warranty claim.

3. Manufacturer's Obligations

Upon receiving a valid warranty claim, the supplier shall, at its sole discretion, either repair or replace the defective part(s) without charge, subject to the terms and conditions of this Warranty. The repaired or replaced parts will be covered under this Warranty for the remaining period of the original Warranty Period. No labour will be supplied or allowed for to fit these parts.

4. Customer’s obligations

The machine must be serviced and maintained according to the manuals provided with the machine by a qualified diesel mechanic. Failure to adhere to the service and maintenance scheduling will void the parts warranty.

5. Exclusions

This Warranty does not cover:

a. Damage caused by misuse, negligence, accidents, improper installation, or unauthorized repairs or modifications.

b. Normal wear and tear of the earthworks machine or its parts.

c. Damage resulting from the use of non-genuine or unauthorized parts or accessories.

d. Damage caused by natural disasters, acts of God, or other external factors beyond the supplier’s control.

6. Limitation of Liability

The supplier’s liability under this Warranty is limited to the repair or replacement of defective parts, as expressly provided herein. The Manufacturer shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with the use or inability to use the earthworks machine.
